Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Voyager ("we", "us", "our") governing your access to and use of the Voyager mobile application and related services (collectively, the "Service"). By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Definitions

"Service" means the Voyager travel journal application, including all features, content, and associated websites.
"User Content" means any data, text, images, photos, or other materials you upload, create, or store through the Service.
"Account" means the user account you create to access the Service.

2. Description of Service

Voyager is a personal travel journal application that enables users to document, store, and optionally share their travel experiences, including trips, photos, notes, and location data. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.

3. Eligibility and Account

You must be at least 18 years of age and have the legal capacity to enter into binding contracts to use the Service. By using the Service, you represent and warrant that you meet these requirements. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information when registering and keep it updated.

4. User Content and License

4.1 Ownership

You retain ownership of your User Content. You are solely responsible for your User Content and the consequences of sharing it.

4.2 License Grant

By uploading User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, reproduce, modify, and display your User Content solely for the purpose of operating, providing, and improving the Service. This license terminates when you delete your content or account, except for content shared with others or as required for legal compliance.

4.3 Representations

You represent and warrant that: (a) you own or have the necessary rights to your User Content; (b) your User Content does not infringe any third-party rights; and (c) your User Content complies with these Terms and applicable law.

5. Acceptable Use and Prohibited Conduct

You agree to use the Service only for lawful purposes. You must not:

Violate any applicable laws, regulations, or third-party rights;
Upload content that is defamatory, obscene, harmful, or infringes intellectual property or privacy rights;
Impersonate any person or entity or misrepresent your affiliation;
Attempt to gain unauthorized access to the Service, other accounts, or our systems;
Use automated means (bots, scrapers) to access the Service without our permission;
Reverse engineer, decompile, or disassemble the Service;
Interfere with or disrupt the Service or servers;
Collect or harvest other users' personal information without consent.

We may suspend or terminate your account and remove content that violates these Terms.

6. Intellectual Property

Except for your User Content, the Service and all content, features, and functionality (including software, design, and trademarks) are owned by Voyager and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

7. Term and Termination

These Terms remain in effect while you use the Service. You may terminate your account at any time through the app settings or by contacting us at privacy@voyagerjournal.app. We may suspend or terminate your access immediately if you breach these Terms, or with reasonable notice for any other reason. Upon termination, your right to use the Service ceases. We may retain certain information as required by law or for legitimate business purposes.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOYAGER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR ONE HUNDRED EUROS (€100). Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Voyager and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. Governing Law and Disputes

These Terms shall be governed by the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey. If you are a consumer, you may have additional rights under your local consumer protection laws.

12. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Voyager regarding the Service.

Severability: If any provision is found unenforceable, the remaining provisions remain in full force.

Waiver: Our failure to enforce any right does not constitute a waiver of that right.

Changes: We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use after changes constitutes acceptance. If you do not agree to changes, you must stop using the Service and may terminate your account.

Kullanım Koşulları

Bu Kullanım Koşulları ("Koşullar"), sizin ("Kullanıcı", "siz") ile Voyager ("biz", "bizim") arasında Voyager mobil uygulamasına ve ilgili hizmetlere ("Hizmet") erişiminizi ve kullanımınızı düzenleyen hukuki olarak bağlayıcı bir sözleşmedir. Hesap oluşturarak veya Hizmeti kullanarak bu Koşulları okuduğunuzu, anladığınızı ve bunlara bağlı kalmayı kabul ettiğinizi beyan edersiniz. Kabul etmiyorsanız Hizmeti kullanamazsınız.

1. Tanımlar

"Hizmet", Voyager seyahat günlüğü uygulamasını, tüm özellikleri, içeriği ve ilgili web sitelerini ifade eder.
"Kullanıcı İçeriği", Hizmet aracılığıyla yüklediğiniz, oluşturduğunuz veya sakladığınız veri, metin, görüntü, fotoğraf veya diğer materyalleri ifade eder.
"Hesap", Hizmete erişmek için oluşturduğunuz kullanıcı hesabını ifade eder.

2. Hizmet Tanımı

Voyager, kullanıcıların seyahat deneyimlerini, seyahatler, fotoğraflar, notlar ve konum verileri dahil olmak üzere belgelemesine, saklamasına ve isteğe bağlı olarak paylaşmasına olanak tanıyan kişisel bir seyahat günlüğü uygulamasıdır. Hizmetin herhangi bir bölümünü makul bir bildirimle (mümkün olduğunda) herhangi bir zamanda değiştirme, askıya alma veya sonlandırma hakkımızı saklı tutarız.

3. Uygunluk ve Hesap

Hizmeti kullanmak için en az 18 yaşında olmalı ve bağlayıcı sözleşmelere girme hukuki ehliyetine sahip olmalısınız. Hizmeti kullanarak bu gereksinimleri karşıladığınızı beyan ve taahhüt edersiniz. Hesap bilgilerinizin gizliliğini korumak ve hesabınız altındaki tüm faaliyetlerden sorumlusunuz. Kayıt sırasında doğru ve eksiksiz bilgi vermeli ve güncel tutmalısınız.

4. Kullanıcı İçeriği ve Lisans

4.1 Mülkiyet

Kullanıcı İçeriğinizin mülkiyeti size aittir. Kullanıcı İçeriğinizden ve paylaşımının sonuçlarından yalnızca siz sorumlusunuz.

4.2 Lisans Verilmesi

Hizmete Kullanıcı İçeriği yükleyerek, Hizmeti işletmek, sağlamak ve geliştirmek amacıyla içeriğinizi yalnızca kullanmak, depolamak, çoğaltmak, değiştirmek ve göstermek için bize münhasır olmayan, dünya çapında, telif hakkı ücretsiz, alt lisans verilebilir bir lisans verirsiniz. Bu lisans içeriğinizi veya hesabınızı sildiğinizde sona erer, ancak başkalarıyla paylaşılan içerik veya yasal uyumluluk için gerekli olanlar hariçtir.

4.3 Beyanlar

Şunları beyan ve taahhüt edersiniz: (a) Kullanıcı İçeriğinize sahipsiniz veya gerekli haklara sahipsiniz; (b) Kullanıcı İçeriğiniz üçüncü taraf haklarını ihlal etmemektedir; ve (c) Kullanıcı İçeriğiniz bu Koşullara ve geçerli yasalara uygundur.

5. Kabul Edilebilir Kullanım ve Yasak Davranışlar

Hizmeti yalnızca yasal amaçlarla kullanmayı kabul edersiniz. Aşağıdakileri yapmamalısınız:

Geçerli yasaları, düzenlemeleri veya üçüncü taraf haklarını ihlal etmek;
İftiracı, müstehcen, zararlı veya fikri mülkiyet veya gizlilik haklarını ihlal eden içerik yüklemek;
Herhangi bir kişi veya kuruluşu taklit etmek veya bağlantınızı yanlış temsil etmek;
Hizmete, diğer hesaplara veya sistemlerimize yetkisiz erişim sağlamaya çalışmak;
İznimiz olmadan Hizmete erişmek için otomatik araçlar (botlar, kazıyıcılar) kullanmak;
Hizmeti tersine mühendislik, decompile veya disassemble etmek;
Hizmeti veya sunucuları engellemek veya bozmak;
Onay olmadan diğer kullanıcıların kişisel bilgilerini toplamak veya hasat etmek.

Bu Koşulları ihlal eden içeriği kaldırabilir ve hesabınızı askıya alabilir veya sonlandırabiliriz.

6. Fikri Mülkiyet

Kullanıcı İçeriğiniz hariç, Hizmet ve tüm içerik, özellikler ve işlevsellik (yazılım, tasarım ve ticari markalar dahil) Voyager'a aittir ve fikri mülkiyet yasalarıyla korunmaktadır. Yazılı iznimiz olmadan kopyalayamaz, değiştiremez veya türev eserler oluşturamazsınız.

7. Süre ve Fesih

Bu Koşullar Hizmeti kullandığınız sürece yürürlüktedir. Hesabınızı uygulama ayarlarından veya privacy@voyagerjournal.app adresinden bizimle iletişime geçerek istediğiniz zaman sonlandırabilirsiniz. Bu Koşulları ihlal etmeniz halinde erişiminizi derhal askıya alabilir veya sonlandırabiliriz; diğer herhangi bir nedenle makul bir bildirimle de yapabiliriz. Fesih üzerine Hizmeti kullanma hakkınız sona erer. Yasa veya meşru iş amaçları için gerekli olan belirli bilgileri saklayabiliriz.

8. Sorumluluk Reddi

HİZMET "OLDUĞU GİBİ" VE "MEVCUT OLDUĞU ŞEKİLDE" HERHANGİ BİR GARANTİ OLMADAN SUNULMAKTADIR; TİCARİ ELVERİŞLİLİK, BELİRLİ BİR AMACA UYGUNLUK VE İHLAL ETMEME KONUSUNDAKİ ZIMNİ GARANTİLER DAHİL ANCAK BUNLARLA SINIRLI OLMAMAK ÜZERE. HİZMETİN KESİNTİSİZ, HATASIZ VEYA GÜVENLİ OLACAĞINI GARANTİ ETMİYORUZ. HİZMETİ KULLANIMINIZ TAMAMEN KENDİ RİSKİNİZEDİR.

9. Sorumluluk Sınırlaması

GEÇERLİ YASALARIN İZİN VERDİĞİ AZAMİ ÖLÇÜDE, VOYAGER HİZMETİ KULLANIMINIZDAN VEYA KULLANAMAMANIZDAN KAYNAKLANAN DOLAYLI, ARIZİ, ÖZEL, SONUÇ OLARAK ORTAYA ÇIKAN VEYA CEZAI NİTELİKTEKİ ZARARLARDAN, KÂR, VERİ VEYA İTİBAR KAYBI DAHİL, SORUMLU OLMAYACAKTIR. HİÇBİR DURUMDA TOPLAM SORUMLULUĞUMUZ TALEPTEN ÖNCEKİ ON İKİ AYDA BİZE ÖDEDİĞİNİZ TUTARDAN VEYA YÜZ EURO (€100) DEĞERİNDEN FAZLA OLMAYACAKTIR. Bazı yargı bölgeleri belirli garantilerin hariç tutulmasına veya sorumluluk sınırlamasına izin vermediğinden, yukarıdakilerin bazıları size uygulanmayabilir.

10. Tazminat

Hizmeti kullanımınızdan, Kullanıcı İçeriğinizden veya bu Koşulların ihlalinden kaynaklanan herhangi bir talep, zarar, kayıp veya giderden (makul hukuki ücretler dahil) Voyager ve yöneticilerini, direktörlerini, çalışanlarını ve temsilcilerini tazmin etmeyi, savunmayı ve zararsız tutmayı kabul edersiniz.

11. Uygulanacak Hukuk ve Uyuşmazlıklar

Bu Koşullar, çatışma hukuku ilkelerine bakılmaksızın Türkiye Cumhuriyeti yasalarına tabidir. Bu Koşullardan veya Hizmetten doğan uyuşmazlıklar İstanbul, Türkiye mahkemelerinin münhasır yargı yetkisine tabidir. Tüketici iseniz, yerel tüketici koruma yasalarınız kapsamında ek haklara sahip olabilirsiniz.

12. Genel Hükümler

Bütünlük: Bu Koşullar, Gizlilik Politikamızla birlikte, Hizmete ilişkin sizinle Voyager arasındaki tüm sözleşmeyi oluşturur.

Geçerlilik: Herhangi bir hükmün uygulanamaz bulunması halinde, diğer hükümler tam olarak yürürlükte kalır.

Feragat: Herhangi bir hakkı uygulamamamız o hakkın feragati anlamına gelmez.

Değişiklikler: Bu Koşulları zaman zaman değiştirebiliriz. Önemli değişiklikleri güncellenmiş Koşulları yayınlayarak ve "Son Güncelleme" tarihini güncelleyerek bildireceğiz. Değişikliklerden sonra kullanıma devam etmeniz kabul anlamına gelir. Değişiklikleri kabul etmiyorsanız Hizmeti kullanmayı bırakmalı ve hesabınızı sonlandırabilirsiniz.
